Jury reaches deadlock in White case

ELKHORN — A Walworth County jury reached a deadlock while deliberating a case involving a man who allegedly attacked two Walworth County Sheriff's deputies. Daniel White, 41, Sugar Creek, faces felony charges of battery to a police officer, use of a dangerous weapon, and failure to comply with an officer's attempt to take a person into custody.

Union Grove man allegedly sold fatal heroin dose

ELKHORN — A 41-year-old man is accused of selling a fatal dose of heroin in the town of Sugar Creek in late June. Stanley A. Bies of Union Grove has been charged in Walworth County Circuit Court with first-degree reckless homicide.

Woman pleads guilty to lesser counts

A 38-year-old former Sharon woman who had sex with two 15-year-old boys pleaded guilty Aug. 29 to several reduced charges.Rachael A. McCormick, now of East Troy, pleaded guilty to two counts of exposing a child to harmful materials, Class I felonies, and two misdemeanor charges of fourth-degree sexual assault. McCormick was originally charged with two counts of second-degree sexual assault of a child, Class B felonies. She originally faced up to 120 years imprisonment.
Woman gets four years for burglary
Chaplin caught in township home

A 59-year-old Delavan woman was sentenced to four years in prison after she pleaded guilty to a felony burglary charge.
Gail A. Chaplin also was sentenced to four years of extended supervision.
On Nov. 15, a Walworth Township couple arrived at their home and found their back door pried open and a women inside their house.
That woman was later identified as Chaplin, who, in 2005, was convicted of burglary and sentenced to five years of probation.
Misdemeanor charges of theft and criminal damage to property were dismissed but considered during the sentencing hearing.
According to the criminal complaint:
When the couple returned home they saw a tan Buick in their driveway and that the back door to their home had been pried open. The man entered his home and saw a female intruder inside. The man told the woman she couldn’t leave until police arrived, but she drove away in the Buick.
The homeowners told police two bottles of prescription medication were missing.
The couple wrote the license plate number of the Buick, which was later located at the Delavan Piggly Wiggly.
When police arrived at the Piggly Wiggly they spoke to Chaplin, who denied entering the residence.
However, both homeowners identified her as the intruder in photo line ups.

ELKHORN — A 41-year-old man is accused of selling a fatal does of heroin in the town of Sugar Creek in late June.Stanley A. Bies of Union Grove has been charged in Walworth County Circuit Court with first-degree reckless homicide.Craig C. Ankney, 39, was found unresponsive June 29 in a Sugar Creek home, and the woman who found him told Walworth County Sheriff’s deputies that Ankney was known to snort heroin.The woman also told deputies that a man named “Stan” sells heroin to Ankney, and the woman identified the suspected drug dealer in a photo.The reckless homicide charge, a Class C felony, carries a maximum penalty of 40 years imprisonment and $100,000 in fines. Bies is being held in the Walworth County jail in lieu of a $25,000 cash bond.In addition to the homicide charge, Bies faces six counts of delivering heroin, one of which is in an amount greater than 10 grams. He faces up to 92 1/2 years imprisonment and $275,000 in fines for the drug delivery charges.According to online court records, Bies allegedly sold heroin after Ankney overdosed from the drug.According to the criminal complaint:On Aug. 26, Walworth County Sgt. Jeff Patek questioned Bies, who admitted to selling heroin. He also said that Ankney was a customer.Bies also told Patek that he sold heroin to Ankney the day Ankney died. On July 1, the Walworth County Coroner’s Office performed an autopsy on Ankney and determined he died from a lethal injection of heroin.According to online court records, the six charges Bies is facing for allegedly dealing heroin stem from sales that occurred in August.

Woman gets jail, probation in family theft case

ELKHORN — Kimberly L. Doran agreed to care for her elderly father and removed him from a “dump” of a nursing home. However, when her dad was in her care, she stole $35,000 from his IRA account.
“This was a serious betrayal of trust,” Judge David Reddy said after sentencing the 47-year-old woman to three years of probation, which was the maximum probation term allowed.
As a condition of her probation, Reddy stayed and imposed all but 15 days of a six-month jail sentence. This means Doran must serve 15 days in jail, and, at her probation agent’s discretion could serve the remanding 5 1/2 months.
Sometime around April 2010, Doran became her father’s power of attorney, according to court documents. Doran made three withdrawals from her father’s IRA account, which totaled $35,000. Because the withdrawals came from an IRA account the victim incurred additional costs for fees and tax penalties. He also lost potential income on interest that the account would have generated.
Doran’s attorney John Dade and Assistant District Attorney Diane Donohoo agreed to a restitution amount before the hearing.
The amount of restitution is $40,000 if Doran pays her father $5,000 within the next 90 days.
However, if she doesn’t, the amount of restitution raises to $45,000.
Donohoo asked Reddy to sentence Doran to probation, but asked him to include conditional jail time to serve as a deterrent to other potential offenders.
“We are seeing more and more cases of people stealing money from family and close friends,” Donohoo said. “If you steal from vulnerable people, like the elderly or infirm, there will be punishment.”
Dade said the victim, Doran and Doran’s husband all resided in the same home in Bloomfield Township. He said some of the money went to cover shared household expenses.
“She was the main person taking care of him,” Dade said.
Dade’s comment drew laughs of disbelief from the victim and two of his friends.
“She was in essence a 24/7 in-home nurse, who was helping (the victim),” Dade said.
Dade said a mitigating factor in the case is that Doran provided her father some care without receiving compensation.
“To that I say, ‘That’s what a good daughter does,’” Reddy said.
Dade asked Reddy to sentence his client to probation, but not to include jail time.
Dade compared Doran’s case to the cases of Johnalee Kawalec and Deborah Hutter. Both women were convicted of theft, and both received probation without conditional jail time. Unlike Doran’s case, Kawalec took her case to jury trial and was convicted.
“Mrs. Donohoo said she asked for jail in those cases, but she didn’t get it, and neither should Mrs. Doran,” Dade said.
Reddy wasn’t the judge in either the Kawalec or the Hutter cases, and he said he wasn’t familiar with either case. As a judge, he said it isn’t appropriate for him to compare the cases.

ELKHORN — Four Walworth County Sheriff’s Deputies who shot and killed a man armed with a sheriff’s shotgun acted within the scope of the law, according to Walworth County District Attorney Daniel Necci.On June 13, Jeremiah Krubert, 39, arrived at his mother’s home where he brutally attacked his mother’s boyfriend and allegedly set the kitchen on fire.When Walworth County Sheriff’s Deputy Todd Neumann arrived at the home, Krubert came at Neumann with a knife and Neumann fired multiple times at Krubert. Neumann backed away from Krubert and demanded he “get down.” Neumann’s firearm had a mechanical failure. Krubert kept approaching Neumann and said, “Kill me, kill me.”
Man gets 14 years for sexual assault

Elkhorn — A 27-year-old man, who sexually assaulted a girl while she was swimming in Geneva Lake, was sent to prison for 14 years.Matthew L. Dennis, who is a resident of Washington state, also assaulted the girl at a home in the town of Delavan. Judge David Reddy also ordered that Dennis spend 14 years on extended supervision after he is released from prison. Dennis also must register as a sex offender for the rest of his life.
Alleged heroin dealer's home raided by DEA, drug unit, East Troy PD

The home of an alleged heroin dealer in the town of Troy was raided July 11 by the Drug Enforcement Agency, the Walworth County Sheriff’s Drug Unit and the village of East Troy police department. Jonathan C. Newhouse, 33, W3420 Highway 20, faces four counts of delivering heroin, possession of heroin with intent to deliver and a misdemeanor charge of possession of drug paraphernalia. On July 23, Newhouse posted a $2,500 cash bond and was released. He was arrested again on July 29 in the town of Geneva for allegedly driving while under the influence of heroin. He faces a felony charge of operating while intoxicated, as a sixth offense. He is now being held in the Walworth County jail on a $10,000 bond. ...subscribers>>
Twin Lakes burglar gets probation
August 08, 2013
A 21-year-old Twin Lakes man who burglarized a Bloomfield home in September 2011 was sentenced Aug. 1 to two years of probation. As a condition of his probation, Dylan J. Gutierrez was sentenced to 30 hours of community service, ordered to pay $100 fine and pay restitution in the amount of $4,000. Gutierrez was convicted in 2012 of burglary in Kenosha County and was sent to prison. He has since been released. ...subscribers>>
