August 20, 2010 | 01:11 PMA 41-year-old Lake Geneva man faces a felony child neglect charge after a 3-year-old jumped out a second-story window while he was sleeping.
David A. Rasch, 1075 Mobil St., allegedly had been drinking prior to falling asleep.
If convicted, Rasch faces up to six years imprisonment and $10,000 in fines.
According to the criminal complaint:
Police responded to a home May 30 in Elkhorn after receiving a report of child that fell out a second-story window of an apartment building.
When police arrived, the child was lying on his back screaming that he was hurt. The child said he jumped out the window because he wanted to play outside and the door was blocked.
At the hospital, the boy was treated for a concussion, bruises and scrapes.
An officer knocked on apartment door for two minutes that was open a few inches, but blocked from opening by a chair.
Through the opening, police saw a child and they instructed him to get an adult in the home. Police witnessed the man leave a bedroom and open the door.
The officer informed Rasch that while he was napping the child fell from a window. Rasch denied sleeping and stated he was on the phone at the time.
Rasch later admitted to drinking and falling asleep. A portable breathalyzer test yielded a result of a 0.06.
