March 13, 2012 | 04:44 PMAfter allegedly driving drunk and crashing into a tree, a 22-year-old Delavan man faces three felony counts for injuries that reportedly happened to passengers in his vehicle.
David Gerald Scott Michalosky, 2317 Prairie View Dr., faces three felony counts of operating while intoxicated causing injury, second and subsequent offense.
If convicted of all counts, Michalosky faces up to 18 years imprisonment and $30,000 in fines.
According to the criminal complaint:
On Feb. 24, police were dispatched to the scene of a one vehicle crash on Laurel Heights Drive in the city of Delavan.
At the scene, police spoke to Michalosky, who said he was driving too fast and was going at least 40 mph when he hit the tree.
He told police that he didn't have a drivers license because of a previous drunken driving offense. Michalosky told police he had "way too much" to drink and that he "shouldn't be driving."
A preliminary breath test came back with a blood alcohol level of 0.11. The legal limit is 0.08.
The passengers in the vehicle were transported to Mercy Walworth Medical Center for treatment.
One of the passengers suffered from a broken rib and bruised lungs. Another had a laceration on her forehead that required stitches. The third passenger suffered bruising to the head and arm.
