The defendant who has already been sentenced faced up to 40 years imprisonment and $100,000 in fines, but the judge choose to impose the four year prison sentence. The other defendant hasn't been sentenced and the judge could choose to impose the maximum sentence, a harsher sentence, a lighter sentence or probation. It won't be known until the judge hands down his decision.

Your logic that the same punishment should be handed out for the same crime is solid. I agree. Unfortunately, consistency doesn't exist in the criminal justice system. Human variables play into these decisions.
