If convicted, Elaine S. Bain, 255 N. Main St., faces a maximum penalty of six years imprisonment and $10,000 in fines.
The charge also carries a minimum penalty of six months imprisonment and $600 in fines.
Bain was sentenced Sept. 30, 2009, in Walworth County Court to two years in a state prison after she pleaded guilty to fifth-offense drunken driving.
That sentence was followed by three years of extended supervision. According to the Wisconsin Department of Corrections website, Bain had a mandatory release supervision date of Sept. 2, 2010.
According to the criminal complaint on the sixth offense charge:
Bain admitted to the arresting officer that she had driven her vehicle.
The officer observed that Bain exhibited slurred speech, glassy eyes, smell of intoxicants and an unsteady gait, all considered signs of intoxication.
Bain has five prior drunken driving convictions with offense dates of Oct. 9, 1994; June 28, 1996; June 10, 1997; Nov. 8, 2005; and Feb. 2, 2009.
